Members of the governing board can be dismissed only for cause and by due process.
   
Off Site Committee Comment
 

The HCC Administrative Rules (6HX-10-1.00) indicate that board members absences will be reported to the governor.  While the compliance narrative states that other rules governing dismissal and due process are found in that rule, the documentation could not be located.  The Florida Constitution provides conditions under which those elected to office may be removed for cause and this legislation applies to HCC board members.  The On-Site Committee should locate documentation as evidence that other rules governing dismissal and due process are found in HCC Administrative Rules.

   
Response of the Institution
 

Hillsborough Community College has an amended administrative rule (6HX-10-1.00) that inadvertently was not provided to the Off-Site Committee.  It addresses dismissal of a member of the District Board of Trustees for cause and provides a Board Member with procedural and substantive due process.  This administrative rule is available on the HCC website under Administrative Rules.
